Veterans' Regulation No. 1 (g)

Entitlement to Pensions

  By virtue of and pursuant to the authority vested in me under sections 1 and 4 of title I of the act of March 20, 1933 (48 Stat. 8, 9 (38 U.S.C., 701, 704)), the following regulation amending Veterans' Regulation No. 1 (a), as amended, is hereby prescribed:

  1. Paragraph IV of part I of Veterans' Regulation No. 1 (a) is hereby amended to read as follows:

  The surviving widow, child or children, and/or dependent mother or father of any deceased person who died as a result of injury or disease incurred in or aggravated by active military or naval service as provided for in part I, paragraph I hereof, shall be entitled to receive pension at the monthly rates specified next below:

Widow under 50 years of age___________________________________________ $30
Widow 50 years to 65 years of age_____________________________________  35
Widow over 65 years of age____________________________________________  40
Widow with one child, $10 additional for such child up to 10 years of age,
 increased to $15 from age 10 (with $8 for each additional child up to 10
 years of age, increased to $13 from age 10)
No widow but one child________________________________________________  20
No widow but two children_____________________________________________  33 (1)
No widow but three children___________________________________________  46 (1)
  (with $8 for each additional child; total amount to be equally divided)
Dependent mother or father____________________________________________  20
  (or both)___________________________________________________________  15 (2)

  1. Equally divided.
  2. Each.

  The total pension payable under this paragraph shall not exceed $75.00. Where such benefits would otherwise exceed $75.00 the amount of $75.00 may be apportioned as the Administrator of Veterans' Affairs may prescribe.

  1. Paragraph III of part II of Veterans' Regulation No. 1 (a) is hereby amended to read as follows:

  The surviving widow, child or children, and/or dependent mother or father of any deceased person who died as a result of injury or disease incurred in or aggravated by active military or naval service as provided for in part II, paragraph I, hereof shall be entitled to receive pension at the monthly rates specified next below:

Widow under 50 years of age___________________________________________ $22
Widow 50 years to 65 years of age_____________________________________  26
Widow over 65 years of age____________________________________________  30
Widow with one child, $7 additional for such child up to 10 years of age,
 increased to $11 from age 10 (with $6 for each additional child up to
 10 years of age, increased to $9 from age 10)
No widow but one child________________________________________________  15
No widow but two children_____________________________________________  24 (1)
No widow but three children___________________________________________  34 (1)
  (with $6 for each additional child; total amount to be equally divided)
Dependent mother or father____________________________________________  15
  (or both)___________________________________________________________  11 (2)

  1. Equally divided.
  2. Each.

The total pension payable under this paragraph shall not exceed $56.00. Where such benefits would otherwise exceed $56.00, amount of $56.00 may be apportioned as the Administrator of Veterans' Affairs may prescribe.

  1. Veterans' Regulations No. 1 (a), as amended, is hereby amended by adding thereto a new part (VI) reading as follows:
  PART VI

DISAPPEARANCE


  I. Where an incompetent veteran receiving pension under part I or part II of this regulation disappears, the Administrator, in his discretion, may pay to the dependents of such veteran the amount of pension provided in part I or part II for dependents of veterans: Provided, That in no event shall pay- ments under this part in any claim exceed the amount of pension payable at the time of disappearance.

  1. This regulation shall become effective April 1, 1935.
